Planning Delegation Scheme

Delegation Scheme for Development Control

 

The following powers are delegated to the Head of Planning and Engineering Services :

 

(applications which fall into these categories need not go to a formal committee)

 

1        To determine all applications for Certificates of Lawfulness.

 

2        To determine whether prior approval is required in relation to all notifications under the GPDO.1995 (as amended) for telecommunications, agricultural and forestry development and demolitions.

 

3        To determine any  application where under the provisions of paragraph 4 the application would fall to be determined by Committee but where a decision cannot be made by Committee before the expiry of a statutory deadline for determination.

 

4        To determine, including the imposition of appropriate planning obligations, or make observations on all other applications under the Town and Country Planning legislation apart from:-

 

          (a)    developments on which the officer recommendation would conflict other than to a minor extent with Stafford Borough Local Plan policies or other relevant planning policies;

 

          (b)    developments which raise unusual issues of planning policy or which otherwise appear contentious;

 

          (c)    applications where a written request for consideration by the Development Control Committee, supported by an appropriate reason, has been received from a Member of the Council relating to an application in their Ward no later than 25 days following despatch of the weekly list of planning applications on which such applications appear, or such lesser period as may be necessary in relation to any prior approval application for telecommunications development where a decision could not otherwise be made by Committee before the statutory deadline for determination.  Where amended plans  and information of a significant nature are received on an application, an additional Call-in period will be given, the period for which will be specified to suit the circumstances of each case;

 

          (d)    applications where a written request for consideration by the Development Control Committee, supported by an appropriate reason, has been received from 3 Members of the Development Control Committee no later than 25 days following despatch of the weekly list of planning applications on which such applications appear, or such lesser period as may be necessary in relation to any prior approval application for telecommunications development where a decision could not otherwise be made by Committee before the statutory deadline for determination.  Where amended plans  and information of a significant nature are received on an application, an additional Call-in period will be given, the period for which will be specified to suit the circumstances of each case;

 (e)    applications submitted by serving members and officers of the Council either in the  capacity as applicants or agents.

 

5        To determine minor variations to permissions, agreements and obligations entered into by the Council.

 

6        To determine submissions for approval under planning conditions.

 

7        To authorise the service of Breach of Condition and Planning Contravention notices.

 

8        To determine all Purchase Notices.

 

9        To determine the publicity arrangements required under the Town and Country Planning legislation.

 

 

Note: In relation to 1, 3, 4, 7 and 8, the Chairman or Vice-Chairman should be advised of the decisions taken by the Head of Planning and Engineering Services.
